- Using any device, software, means or routine that interferes with the proper working of the Website, including but not limited to viruses, trojan horses, worms, logic bombs or other such materials.
- Attempting to gain unauthorised access to, interfering with, damaging or disrupting any parts of the Website, the server(s) on which the Website is stored, or any server, computer or database connected to the Website.
- Attempting to attack or attacking the Website via a denial-of-service attack or a distributed denial-of-service attack.
- Otherwise attempting to interfere with the proper working of the Website.
- Using the Website in any way that violates any applicable province, territory, state or country laws, rules or regulations.
Your use of the Website and any dispute arising out of such use of the Website is subject to the laws of England and Wales.
Membership Terms and Conditions
Our aim is to ensure that you have a positive and enjoyable experience throughout your time in Membership with the Merton Chamber of Commerce. We also hope you will benefit fully from all available services and opportunities we offer. By applying to become a Member of Merton Chamber of Commerce, you are agreeing to be bound by the following terms and conditions. These terms and conditions are subject to variation from time to time. Variations will be updated on the Website, and the latest version of these terms and conditions will be available there.
These terms and conditions should be read in conjunction with the Terms and Conditions for Event Bookings.
Application for membership
- Membership is open to sole traders, partnerships, companies and other organisations regardless of their location.
- Membership is a business entitlement rather than a personal one. All employees of the ‘Member’ are therefore entitled to all Merton Chamber benefits and services when working on behalf of their Member’s employer.
- Your Membership will come into effect from the date Merton Chamber receives payment of your membership fees and shall, unless otherwise terminated in accordance with these Conditions, continue for a period of 12 months and, thereafter, shall continue unless terminated by either party giving no less than one months’ written notice to the other party.
- Each membership is for a minimum period of 12 months, meaning that the full 12 months’ membership is payable, even if the member chooses to terminate their membership within the 12-month period.
- If a member subscribes to membership through the Website, payments will be processed automatically through Stripe. These payments will be recurring charges, made to the credit or debit card provided by the member at the time of sign-up. Stripe charges will be processed on a subscription basis, where payments will continue until the membership is cancelled by the member.
- Membership will automatically renew for the next membership period as each 12 month expires. You will receive a renewal notice approximately six weeks in advance of the renewal date informing you of any changes to your membership fees. Payment of membership fees will automatically continue unless you notify Merton Chamber and your payment provider that you wish to cancel. If no such notice is received, you shall be liable for the subscription for the ensuing year which shall be a debt due to and legally recoverable by Merton Chamber.
- Membership fees are non-refundable and non-transferable.
- On cancellation or termination, the benefits of membership will cease. You will not be entitled to any benefits after the date of cancellation or termination. This includes any event booked, where the date falls after the date of expiration.
- Membership is subject to the provisions of the Articles of Association of Merton Chamber and in the event of a conflict between these Terms and Conditions and the Articles of Association, the Articles shall prevail.
- If you are accepted as a member but it subsequently turns out that any or all the information provided by you was misleading or false, we reserve the right to revoke the membership with immediate effect, without the right of appeal. If you and/or your business have been convicted of a criminal offence which is not yet spent, or have a prosecution pending, this must be declared. All information given will be treated in the strictest confidence and only considered if relevant.
- We reserve the right to reject any person as a member in our absolute discretion.
Membership Fees
- Membership fees are due annually in advance based on the membership tier selected at the time of registration or renewal. Membership fees will be charged monthly via Stripe.
- An invoice for the annual membership fee can be provided upon request. Please contact the Merton Chamber team directly to request this at accounts@mertonchamber.co.uk
- Merton Chamber reserves the right to review and amend membership fees annually. Members will be notified of any changes to the fee structure in advance of their renewal date.
- We reserve the right not to fulfil, or to cancel, your membership if we are unable to obtain payment authorisation from your card issuer or bank in the case of direct debit payment.
By making payment for your membership, you are deemed to have agreed to the terms and conditions on this webpage and to abide by our Professional Code.
Obligations of Members
As a member, you shall:
- Co-operate with Merton Chamber in all matters relating to the Membership and the membership services set out below.
- Provide, in a timely manner, such information as Merton Chamber may reasonably require.
- Ensure that all information you give us is accurate and complete in all material respects.
- Verify that you are you who you say you are.
- Ensure that the address you have provided is correct and can be verified.
- Ensure that your account number and sort code or a valid credit or debit card (depending how you pay the membership fees) are kept up to date with our payment service provider.
- Confirm that you are authorised as a signatory on the bank account and/or credit or debit card you have paid with.
- Be responsible for maintaining the confidentiality of your account on the Website and password, including but not limited to the restriction of access to your computer and/or account. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
- Consent to your business details appearing on the member directory on the Website and be responsible for maintaining an up-to-date listing of your business in the Member Directory.
- Comply with our website terms of use set out above.
Membership services
Merton Chamber shall make the following membership services available to the member.
- Member rates on all our events and training courses.
- Access to our downloadable materials from the Website.
- A listing on the business directory on the Website, the position depending on your tier of membership.
- Access to the Member Area where business to business offers appear.
- Additional services as notified to you from time to time.
Merton Chamber shall be entitled to vary the membership services at any time. Such amendment shall not give rise to any liability for refund of membership fees paid. However, where a membership service is withdrawn, Merton Chamber may implement a suitable alternative (where demand for the current membership service is high enough).
If you cease to be a member of Merton Chamber, then your access to the membership services shall automatically expire.
Our liability to you
Any advice provided to members by Merton Chamber, its employees or anyone purporting to act on behalf of Merton Chamber is intended as initial guidance only and should not be relied upon or acted upon as substantive advice by the member, who should seek appropriate independent professional advice according to the nature of their problem. Merton Chamber does not accept liability for any such advice.
We shall not have liability to you for any (a) loss of profits, (b) loss of sales or business, (c) loss of agreements or contracts, (d) loss of anticipated savings, (e) loss of use or corruption of software, data or information, (f) loss of or damage to goodwill, and (g) indirect or consequential loss.
Save as excluded above, our liability to you for any breach of these terms shall be limited to the amount of the membership fees paid by you in respect of the annual period in which the breach occurs.
References to liability include every kind of liability arising under or in connection with these terms including liability in contract, tort (including negligence), misrepresentation, restitution or otherwise.
Nothing in these terms limits any liability which cannot legally be limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Business Between Members
We want to build a supportive and engaging network for our members and encourage them wherever appropriate to conduct business with each other. As a member of Merton Chamber, you will meet other members who offer advice, products or services which may be of use to you in your business.
- If a member purchases a service or product or takes advice or assistance from another member, or an organisation they have been introduced to by Merton Chamber, the arrangement is made purely between those entities. In no circumstances will Merton Chamber be a party to any contract between our members or have any liability for advice, services or products provided by one member to another.
- Merton Chamber does not warrant the quality or suitability of, or accept any liability, for the service or product sold or the advice or assistance provided by any member whatsoever. Members should conduct their own due diligence, seeking independent professional advice in accordance with the nature of their situation.
- Members shall not send unsolicited emails or correspondence of any kind (“spam”) to other members. Correspondence may be considered spam if it is not addressed to the intended recipient and/or if the content of the correspondence is not relevant to the intended recipient. Any member who breaches this clause may have their membership terminated.
Data protection
By joining Merton Chamber, you give your consent for us to contact you. When you become a member, we require the following details as a minimum:
- Business/company name
- Address
- Email addresses
- Business telephone number
- Individual contact details for delegated primary contact
- You may also provide us with personal contact details for your staff or other individuals associated with your business (additional contacts) where you want them (or they want) to receive information or access services from Merton Chamber. By giving us this information, you are agreeing that we may contact the delegated primary contact and additional contacts from time to time by email with information related to services, products, events and how to make the most of your membership. You or they may opt out from time to time.
- You agree that we will not be responsible for non-delivery of our contract obligations where you have failed to inform us of changes in contact information.
- We will process your personal data in accordance with Merton Chamber’s Privacy Policy, which can be found here.
Intellectual Property
Use of the Merton Chamber’s logos and branding by Members is not permitted by any member or non-member business, unless agreed by us in writing, however members can use the ‘member of’ logo. Members may not advertise or describe themselves as ‘in partnership with’, ‘approved partner’, ‘patron of’, ‘approved by’, ‘supplier to’ or other similar claims, unless an agreement as a supplier, partner or patron exists between Merton Chamber and that member.
General
Entire agreement. These terms constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
Force majeure. Merton Chamber shall not be in breach of these terms nor liable for delay in performing, or failure to perform, any of its obligations under these terms if such delay or failure result from events, circumstances or causes beyond its reasonable control.
Prize draws and competitions: Any prize draws or competitions associated with our offer are subject to separate terms and conditions, as written at the time of the prize draw, competition or offer.
Governing law: These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.
Jurisdiction: Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Conditions or its subject matter or membership.

Merton Best Business Awards - Entry Terms and Conditions
Eligibility:
- The competition is open to any business or charity with a significant operation in Merton and is free to enter.
- Membership in the Merton Chamber of Commerce is not required to enter.
- Sponsors are eligible to enter all categories, including the public vote.
Application Information:
- Information and evidence submitted in applications must be accurate and truthful.
- Supporting marketing materials and additional evidence are welcome but not mandatory.
- Businesses agree to keep supporting materials up to date if required by the organisers.
- By entering, you consent to having your contact details shared with award partners and sponsors for purposes related to the awards.
Category Entries:
- Businesses may enter multiple categories without restriction.
- Entry to the Public Vote category is open to all businesses in Merton.
- The Best New Business category is open to businesses that commenced trading within the past two years.
Judging:
- The judging panel will include representatives from sponsors and other professionals.
- Award sponsors cannot enter the award they are sponsoring.
- Entries will be assessed independently by multiple judges.
- Sponsors will not be included in the judging panel of their own applications.
- Sponsors or judges may contact entrants regarding their applications.
- The organisers may reallocate entries to more suitable categories if necessary.
- The judges’ decision is final, and feedback will not be provided for individual entries.
Insufficient entries:
- The organisers reserve the right to withdraw categories that do not receive sufficient entries of a winning standard.
Publicity and Promotion:
- By entering, you agree to participate in publicity, including the use of your business name and images for promotional purposes.
- This includes post-event publicity and future award-related promotions.
Attendance at the Awards Ceremony:
- Finalists must have at least one paid for representatives at the awards ceremony.
Future Changes:
- The organisers may make minor updates to these terms to comply with legal, technological, or business changes.
- Entrants will be informed if significant changes are made.
By entering the Awards, you agree to the above terms and conditions. Entries that breach these terms may be disqualified without refund or recourse.
